I'm of a similar opinion myself Kris, although some co-ordination would certainly be needed. As to finding a sympathetic legal ear, I guess we have to ask around, maybe one of us might know some such person? I would certainly be willing to expend effort to holding these people accountable, but how do we mobilise a more widespread boating community to take an interest before it becomes too late? Sadly GOBA are only too ready to promote the transfer from EA to CAN'T Yes, I know mate, and you've reminded me I was going to write to their magazine about that very subject! They did print a letter a couple or so issues ago which did say be careful what you wish for. When writing I must trawl around for examples of their ineptitude, not just in their application of the law, but their maintenance failings, which appear to be worse than the E.A, and they are certainly no angels. Makes you wonder what's in it for GOBA? Personally, as things stand, I'd much prefer to keep the devil I know.

I get the feeling the leading lights at GOBA are using the IWA template - what was once a very good organisation for the benefit of their members changes for the worse when they cosy up with the navigation authority they should be holding accountable. It all sits badly with me, and like you I'd rather stick with the EA - for all their failings!

A Judicial review into the correct meaning of sect. 43, 1962 TA if it broadly agrees with Nigel's interpretation will drive a stake through CRT's plans to trash boaters statutory rights, they will be crucified.
What are we waiting for ?

What are we waiting for ? Aside from anything else - the right "factual matrix". The current case could have provided that, but I suspect it is all too late. There will be others though.

What are we waiting for ? But generally you have to be directly affected and/or disadvantaged personally by the decision you are seeking to have judicially reviewed. I don't think a court will give a 'general' ruling without consideration of the circumstances of an individual case brought by the party affected. Of course, a ruling that a decision or course of action was unlawful or unfair in a specific case would provide useful guidance in any subsequent similar case and would certainly dissuade the authority from pursuing such action in future.

As you all may know I recently paid my/our membership fee for 2017 to the IWA, in the belief that it would help towards coffee and biscuits for the volunteers who maintain and reclaim the canals. If the IWA is turning out to be a "wrong 'un" then I am quite happy to write to them and question what they are all about. If the IWA are failing then there's nothing to stop anyone from contacting them and letting them be aware of your thoughts. A list of what they do right, and a list of what they do wrong would be helpful for starters. They sell nice Christmas cards.

The IWA are frustrating. Projects like this www.project-hereward.org/Are exactly what they should be about - most of the branches seem to do useful work for the waterways in their area. Getting into bed with the upper echelons of CRT are not what they should be about at all.

Perhaps Thunderboat would be an excellent platform for composing a letter to the IWA? Each member could chip in their comments, and someone could edit the whole bundle, then post it to the IWA. It's a thought. The final draft would need to be approved by all who participated. Christina shows by example:

I havent heard much from the NBTA recently, They did seem to be a group willing to prod CANT with a pointed stick sometimes.
