Well, I would presume that as he has said that it is impossible for him to move safely, then he must be on the river, not a canalised section. That seems pretty clear to me.

On the other hand, if the only direction one can move is the opposite of that in which you're travelling, the move is only to avoid over-staying, and it is arguable that that would not be "bona fide use for navigation"! This of course could be true - but a better defence than not moving at all.

Running downstream on a river in flood is not usually a good idea. running upstream requires plenty of poke, but may be a wste of time if air draft is restricted at sluices, locks, bridges and other structures that cross the river. EA advice for rivers on Strong Streams. What is Strong Stream Advice? Strong Stream Advice procedure advises boat users that locks may be reversed and that the Environment Agency strongly advises against attempting to navigate. Locks may not be available for navigation and bridge heights may be restricted. River flows between structures may be too fast for safe manoeuvring. At times of high river flows some locks are used for water discharge in addition to the adjacent sluices. Lock vee-gates may be chained and locked open so that flood defence personnel can quickly adjust flows using just the guillotine gate. Tampering with the chains or padlocks could cause vee-gates to slam shut with enormous force, is highly dangerous to boaters and flood defence staff and may cause serious damage. on top of the obvious distress that the owners of this will have undergone, they will probably find that their insurance is invalid as well. Last I heard it went to Blackthorn Marina after these muppets recovered it It was refitted and now has a new owner, I dont know if the couple that lost it on that day are still boating though.

Kris says in his first post that the river is in flood and it is impossible for him to move safely. This must mean that he is already on the river, so why should anyone challenge that? Yes it does suggest that, however knowing that kris can sometimes be economical with the truth it seemed appropriate to check the facts. No accusations were made, simply a request to remove any possible ambiguity. The response we got suggests that kris probably isn’t giving the whole picture.

Fair enough. I really don't want to engage with you in a battle of wits, when you're ill equipped, but I said no such thing. Just to clarify. kris says the river is in flood and he therefore cannot move as he considers it unsafe. That view has been wrongly challenged by C&RT and furthermore questioned by you, the clear implication being that his word his insufficient and YOU require further proof. Such a view is appalling in my opinion, and evidence that whatever kris or anyone else says will not sway you from your entrenched position. For my part I will cease the forlorn effort. Hope that clarifies my position to your satisfaction, but frankly, I don't really care. Sorry. Rog

Anyway to answer your question because experience has taught me it isn't worth entering into a discussion about issues like this with Nick or yourself. In other words I dint value yours or nicks opinions very highly. We haven’t given an opinion. Not in a position to do so as the facts aren’t clear. But I will offer this opinion: if you carry on over the phone to CRT in the same way that you carry on here, it is no wonder you don’t get the responses you’d like. You have no idea how to interact with people so as to get the best out of them.

Well yes I think some on here would just like it if everybody agreed that CRT are a crock of poo all of the time but it does however remain a public forum where opinions can be expressed that may differ from the 'group think' that sometimes pervades. That is the nature of the beast it remains a forum none the less.

No level of incompetence by CRT surprises me, having had the fun of calling them (as per their request) on a given phone number, getting an answering machine, leaving messages (with the return phone number clearly enunciated) but never being in receipt of a reply
