Thats just blatant loophole seeking though isn't it.
The only outcome of this will be closure of the loopholes.
It's not rocket science really.
One does have to wonder who it was who at some stage decided that you could be exempt from the BS scheme while having a fuel burning appliance on the boat...

Somewhere in the bowels of the forum the original BS exemption was posted and also the updated version. I wonder if TonyDunkley can republish these. I hope you are well Tony, and I do wish you the best of outcomes in this story as I believe you have a point but I don't quite understand why you did not get a BS ticket.

Thats just blatant loophole seeking though isn't it. you might consider that but you can't honestly or morally introduce extra requiremnts retrospectively
If they made the loophole they are obliged to stick with it, as it is a contact (as they claim) it is part of the published terms and conditions.
They can do a quick revamp of the terms and conditions for future aplications

My position too although to be fair Tony did state that he had been trying for several years to goad CRT into siezing his boat. Which, although I won't pretend to understand why, is his perogative. What I can't understand is why, now they have fulfilled his long-term desire, he now seems to have a sad-on about it.

A contract.
Yes I suppose so, makes sense.
So do we really think this was victimisation? I suppose there is an argument for it but I still don't quite "get" the whole thing. There is something not right about it all.
Someone earlier on mentioned a rabbit, which I think was a spot on comment.
Rabbit and hat. Yes. That would be ideal.

For me I can’t understand why Tony didn’t get a BS ticket then he could have gone to court over the main navigable channel argument.

I think he is enjoying it, and merely using this forum to make the soup thicker.

My thoughts also on the bss, and in hindsight I bet Tony would not take that route again, but obviously he won’t admit that.

There is no 'updated version' of the private boat BSS Exemption Form, . . there is ONLY this one : - < canalrivertrust.org.uk/media/library/733.pdf > It was published on C&RT's website long BEFORE I applied for a PBC for "Halcyon Daze" in August 2019, . . it WAS current on C&RT's website WHEN I applied for a PBC for "Halcyon Daze" in August 2019, . . and it's still current on C&RT's website RIGHT NOW - some 16(+) months later. So much for 'closing loopholes' ! The wording on the form is clear and unambiguous, . . there is NO MENTION of solid fuel stoves ANYWHERE on it ! Moving goalposts for no other reason than to 'manufacture' grounds for taking the draconian and illegal action of 'seizing' someone's goods and property is NOT acceptable under ANY circumstances !

Not at the time the BSS Exemption Form was submitted to C&RT, by an independent third party witness, . . along with the application, and payment, and proof of adequate third party insurance cover, for the Pleasure Boat Certificate that the Court had specified as an acceptable, and lawful, alternative to a Licence in para. 1 of the Order made on 15 August 2019.
