I must advise you though that I will take an impartial view of whatever I discover and will not automatically take the side of the boater simply because I am a boater. However, I will give you my thoughts, if any, and advice on how I think the current situation should be approached, although I suspect it may be too late to do anything in your case. Are you going to look at the evidence and atrocities that they C&RT have and are doing, seriously i need you to look at this and then give your views, after the readings and you’re checking of evidence is contemplated , checked , then submitted to us, would be helpful and appreciated

Perhaps a separate thread could be started to share the facts regarding the seizure of Planet... If the collected brethren wish to have them under this umbrella...or is there one already? or am I thinking of over the road where I don't venture any more? I kinda remember bits n bobs about it. Just a thought....I have a few occasionally...feel free to ignore

I do hope that bigredlv23 realizes how fortunate he is in securing the services of Shit-for-Brainsmiths LLB.
This new to the market source of legal advice is rapidly making a name for itself in the UK, mainly thanks to the scope and quality of the help and guidance to be had from the proprietor, but also in the remarkable way he's overcome a physical disability that would have held back lesser men.
With his vocal chords and voice-box situated just inside his rectum and unable to speak without first standing up and turning away from whoever he's addressing, life can't have been easy for him. There are, however, rumours circulating that he's been offered a salaried position as a consultant to C&RT's Illegal & Governance Services. Apparently, the senior lawyers there have been feeling increasingly uncomfortable in their roles of late and are in need of the reassuring presence of someone even more stupid than they.

It all comes down to "the letter of the law" Halcyon Daze complied with the requirements for exemption as published by CRT ........ doesn't matter if you I or anybody else (including CRT) think something else should be included. ........ you can't introduce an extra requirement retrospectively ....... even to this day, the published requirements still does not include solid fuel heating !!!
Tony was complying with the letter of the law ...... which is the whole point.
I have already previously posted that in his place, I would have got the BSC and then if they had then introduced some other reason for not issueing a registration he would have had an even stronger case against them. This is not because I think CRT were acting correctly because I don't, my reason would have purely been because it's better to fight one battle at a time.

The main difference between Planet and Halcyon Daze as I see it is that in the first instance, the owner did not want the vessel to be removed whereas in the second instance the owner freely admits that he spent several years deliberately goading CRT into removing it. What I don't understand is why Tony appears to be so aggrieved that the inevitable finally happened.

Irrespective of whatever C&RT persuaded you to give your signed agreement to on some Licence Application form, a ''Licence'' is NOT a form of contract, . . NEVER has been a form of contract, . . and NEVER WILL be a form of contract.
The three statutory conditions, compliance with which make the issuing of a PBL or a PBC mandatory for C&RT are set out in S.17(3) of the BW Act 1995.
Continuing non-compliance, following a 28 day warning, with any or all of the above mentioned three statutory conditions are the ONLY grounds on which a PBC or a PBL may be lawfully terminated.
You've indicated a preference in your above post for a less personally confrontational approach than mine to all this licence T&C's crap that C&RT are foisting on the gullible pleasure boating public, but in advocating such an approach you appear to be losing sight of the fact that ALL of this legally unenforceable extra-statutory piffle emanates from a handful of readily identifiable worthless tosspots in C&RT's Licensing and L&GS departments.
The pointless waste of space C&RT employees, apart from CEO R.Parry, lurking behind all this diversionary nonsense are M. Aymes, who in any properly run organization wouldn't be entrusted with anything more onerous than emptying waste paper baskets and cleaning the bogs, . . T. Deards, nominal 'Head' of Illegal, . . and L. Barry, the glib talking Solicitor-Advocate who 'sells' all the specious pseudo-legalistic garbage to the Judiciary, . . as and when necessary.
I reckon that's just about as 'personal' as things can get, . . and not only for me, but for everyone affected by the unlawful actions perpetrated in the name of the C&RT, . . but in truth originating from a small out of control rogue faction whose contempt for C&RT's 'customers' is exceeded only by its even greater contempt for the Law in general and C&RT's governing legislation in particular.
