. the truth is that S.8 of the 1983 Act authorizes only the "removal" of certain specified craft from the location where they are "sunk, stranded or abandoned" or "left or moored without lawful authority". - You are reading too much into this, as usual. Until and unless someone can show that "removal from a location" specifically excludes lifting and transport your point is basically without merit.

The part about offering no contest and still being found in favour. And yes, if you hear any chat on the subject it would be interesting. I was aware of the case, it was reported quite a lot locally, I don't know of I knew about the injuction before reading about it on the links here, I can't remember. From the few posts I just looked at, opinion seems divided. But that I guess is expected. There are few posts offering facts at the moment. I going to guess there will be activity once CRT sneak in. The facts are rather dull; a boater failed to stay within the rules and as a result is going to have an unpleasant encounter with some removal chaps. The rest is mere speculation and perspective.

What he's busting a blood vessel over is hoping someone will be foolish enough to contest the 'without lawful authority' part. Shit or bust actually, so I think the spiel will commence before too long anyway.

I wonder if it is Section 8 of the 1983 BW Act 8(2) seems to be quite clear about the board's right to remove relevant craft and it does not mention "from their location". Anyway even if it did it would be surplus wordage as it is obvious to anyone that if you remove something it will no longer be in the location it was previously.

Rubbish, . . I'm not 'reading' anything into anything. What I am doing is drawing attention to the wording of Sections 8 and 9 of the 1983 Act, . . which is something that C&RT's shyster lawyers are VERY careful NOT to do whilst they're lying to and misleading the Courts into miswording Orders for Declaratory and Injunctive Relief.

Otherwise it wouldn't be removed.

Sec 9 "Remove from" seems quite explanatory in case anyone was unsure.

Sec 9 "Remove from" seems quite explanatory in case anyone was unsure. The whole thing is totally unambiguous.

What I am doing is drawing attention to the wording of Sections 8 and 9 of the 1983 Act, . . It was you who brought section 9 into the topic. Prior to that everyone knew it was an irrelevant diversion. as usual. Can you please quote the part of SECTION 8 which mentions removal from a location. Ta.

Section 8 Shall we do another irrelevant diversion now and talk about section 7? Or section 2 ?

If, within six weeks of its removal... any relevant craft cannot be proved... to belong to any claimant... it shall... vest in the Board.
vest in sb/sth phrasal verb with vest verb [ I or T ] UK /vest/ US LAW if property, shares, etc. vest in someone, they legally become theirs:
