So are we entering a world where we can’t call eachother a twat in the virtual world, but it’s still acceptable in the real world? None of us can act online without consequences of our actions. Many seem to think that it's just a make believe world that shouldn't be taken seriously, I question that view. Something the world is still pondering on to find a solution, in my opinion. I wonder, could this be solved by adding something in the T&C’s to say that if we are a member of this forum, we accept it’s primarily a form of entertainment and and will not take legal action against any of it’s members? Corporations get away with NDA’s, why not a similar thing (but can’t think what you’d call it...)

I've signed many NDAs over the years, if anyone tried to use them against me for anything other than purely 'confidential' business reasons, I'd have screamed.
I have my interpretation of what the agreements meant but when life went wrong I discovered that others had other ideas, such is life.

I haven't ever signed an NDA and if someone asked me to I would look them in the eye and say "Don't be silly, that's for children."
Off to bed now with axe in my hands, as it's dark here and we are in Unknown Territory.

Tony Dunkley's imaginary firm of no-win, no-fee libel solicitors, as recommended by his imaginary friend won't be taking legal action against me, any more than PLA did- his vacuous posts are simple the typical inane delusions of an Alzheimer's Disease sufferer. Any theoretical legal action which did happen could be nipped in the bud in an instant with a defence of "fair comment".

It was "no win no pay" as opposed to "no win no fee".
That was the terminology used. Whether this has a material effect in the outcome of the case I would have to refer you to my legal team.

I was recently asked to be a Beta tester for a company who write software for the music recording industry. I had provided some bug reports to them, so I thought they were interested in my skills being an ex software engineer.
They insisted I sign an NDA. So as well as doing their testing for free, they also expect me to keep their bugs secret from the public. Yeah, right..,,

NDAs can go far more than that. Lets just say you fall out with a company about how much work is involved (due to changes in spec), things get serious over time and 10s of £k are involved in the eventual dispute. Contracting company will not negotiate or let you tell your side of the story due to the NDA. bye bye money - fuck you Arriva Trains

If so, their NDA will likely be to offer them some protection under Sarbanes-Oxley. I have signed many NDAs when beta testing software, it was no big deal. Leaving aside the rest of the drivel in the above post, I'm curious about your reference to the PLA. Precisely where, and how, do they come into any of this, and above all, when was there ever any suggestion, threat, mention, or anything else, at any time, that the PLA had any cause to take any sort of 'legal action' against you ? Oops Yes, . . and what's even more interesting is WHO it was that posted section/paragraph 18 (Objectionable Content) from the ProBoards T&C's back in March this year, in a thread entitled "Forum at Risk", . . . proof enough, if anymore was needed that he can't even understand the contents, and more importantly the implications or possible consequences, of what he's posting ! There is, of course, always the alternative view that he doesn't care about the possible consequences.
