I know its been covered before but I have been wondering what the legal situation is on all this. I don't know if makes a difference whether your boat is your home or not. I'll outline a basic example of a potential situation. It has not happened to me yet as they always run off when I get my large boathook out but..just as an example You are in your boat with family member and someone steps onto the back of the boat so you go and ask if they are OK/what they are doing. At this point it becomes apparent that there are more than on of them and they become threatening. At what stage is one allowed to get the axe out and throw it at them? I believe that in the Tony Martin case the fact he had been telling people beforehand that he wanted to kill intruders counted against him in court. I'm just intrigued to know at what exact point you have a valid self defence argument. Its all a bit technical.

There is no legally clearly defined point, it depends on the individual case although Id say that if some little old lady looked at me a bit funny then that would be sufficient justification to butcher her in a frenzied bloodbath.

Tony Martin is from Emneth Hungate which is as good as banjo country as you will get, what went against him was shooting that little gypo shit in the back as he fled.
Stabby will disagree but the same rules apply as defending your land based home - eg, reasonable and proportional force to protect you and your family.

A lovely bunch of people to have as friends. What I understand here is that one isn't even allowed to deal class A drugs freely in the UK, and one isn't allowed to kill and burn basterds either, what's left over to do if you want to have some fun now ? Peter.

I've not done the math but I suspect that dealing with two dead people is going to be a lot more than twice as difficult as dealing with one dead person.
Of course there is the "the other one will leg it" argument but that can't be relied on.
I reckon if you are confident in your abilities and depending on location you could kill a single intruder and deal with it and never have a problem but if there are more than one that's when the shit hits the fan.

Not really. Time is of the essence.
I've never got into this myself but if you are going to kill an intruder you need to do so quickly and dispose of the the evidence fast. Giving them (said intruder) an opportunity to make a phone call to their lawyer/police/mum is not going to be a priority.

If it was the middle of the night and I was with my family I would be loath to open the door, if doing so was unavoidable I would I make sure had something wieldy to hand and be prepared and able to use it. If you disable someone who is actively trying to break into your boat, family on board, dead of night and moored in the middle of nowhere, providing you don't actually kill them and you had given them the chance to fuck off I can't see a problem legally or otherwise. If you moor in a town centre on a Friday night and go on a vigilante rampage with a baseball bat every time a bunch of half-pissed teenagers/students/Estate Agents interfere with your craft in an 'amusing' fashion you will end up Arrested and/or Sectioned in fairly short order. There are two words that when conjoined form a short phrase that should be our Touchstone in all our dealings with others, good or bad; Fair and Proportionate.
