Illegal boat confiscation/seizure by Canal & River Trust
From the events of 16 November 2021 on the Leeds & Liverpool canal at Burscough, it is evident that the C&RT has every intention of persisting with its long established and well practised routine illegal seizures -- theft, in other words -- of privately owned pleasure craft from the publicly owned inland waterways for the time being under its dubious control. On 16 November last, historic Leeds & Liverpool Shortboats Wye & Mersey were unlawfully seized at a private mooring on the canal at Burscough by contractors acting for, and under the direct instructions of, the Canal & River Trust. Three other privately owned pleasure craft were also illegally seized at the same time. The five illegal seizures were executed by way of C&RT's much favoured and thoroughly dishonest contractor's, Commercial Boat Services, well practised unlawful procedures of deploying bogus Bailiffs, not authorized or certificated by any Court -- a serious criminal offence in itself -- and producing carefully worded but meaningless fabricated documentation to the Police officers attending, at C&RT's request, in order to fool the Police into believing that the seizures were lawfully executed pursuant to what are in fact wholly fictitious, non-existent supposed statutory powers of seizure under the much abused and misused Section 8 of the British Waterways Act 1983. __________________________________________________________________ Will the owners themselves, or anyone who can assist in putting us in contact with the owners, of any of the five illegally seized vessels, please contact us by either replying to this post, or if they would prefer, directly at : - < Tonydtrent@gmail.com > or by phone on 07903 063179. ____________________________________________

The Canal & River Trust's dishonest and corrupt management fears nothing so much as having the illegal activities they so readily and frequently indulge in exposed to public, or more especially, Judicial scrutiny. The weight of evidence of the Trust's wrongdoings since replacing British Waterways as the custodians of the publicly owned inland waterways network is already considerable, but as yet falls short of overwhelming.
Evidence from others who have suffered financial or material loss as a direct consequence of C&RT's management's calculated misuse and abuse of both its statutory powers, and the Courts that its retained lawyers knowingly and contemptuously mislead as to the scope and effect of those powers, can only serve to improve the probabilities of a just outcome to the impending civil and criminal actions. Is there anywhere on the internet where it is possible to read what actually happened at Burscough on 16th November, and the history behind it?

Not at present, Duncan, but from the info gathered so far it appears that this particular example of C&RT's customary boat thieving procedures had its roots in the 'End of Garden' mooring fees scam, rather than the boats simply being 'unlicensed'.

Mr Parry,
On 22 October 2020 I was forcibly and unlawfully evicted from my home by agents of a company trading under the name of Commercial Boat Services and claiming to be acting on the instructions and under the authority of the Canal & River Trust, and as authorized Officers of the Court. My home at that time was a a 50' boat, said by the Canal & River Trust to be a houseboat, and was kept and moored on private land on the River Trent at Barton-in-Fabis near Nottingham.
Immediately after I was unlawfully evicted from my home - "Halcyon Daze" Index No. 52721 - the boat was seized and removed by Commercial Boat Services, to an undisclosed destination, complete with all contents including bedding, clothing, cooking equipment, food, trade tools, and personal and business records.
Attending, and in overall charge of my unlawful eviction from and the subsequent seizure and removal of the vessel was Canal & River Trust's Licence Support Supervisor Stuart Garner, who misled the Police he had asked to attend into believing that he was a statutorily qualified Enforcement Officer supervising the execution of a Court Order authorizing the seizure and removal of my boat/home by the personnel supplied by Commercial Boat Services and misrepresenting themselves as Bailiffs acting on the authority and instructions of the Court.
In a written report now in my possession, the Trust's Mr Garner compounded and elaborated on his lies of 22 October 2020 when later questioned by Nottinghamshire Police, giving the impression that he had been statutorily empowered via the current applicable legislation and authorized by the Court to supervise the seizure and removal of my boat/home pursuant to the recovery of debt arising from a successful monetary claim by the Trust.
Since the last contact with the Trust concerning this matter, evidence has been gathered from the owners of eight boats, all of whom have been unlawfully deprived of their vessels and other property in a similar manner via the combined illegal activities of Commercial Boat Services, its bogus 'Bailiffs, and the Canal & River Trust in abusing and exceeding both its specific statutory powers and its obligations under UK common and statute law.
Prior to issuing proceedings we would appreciate either confirmation or denial from you, as CEO, that you are aware of the Trust's above mentioned illegal activities and that they meet with your approval.
In the interests of the openness and honesty to which you so frequently and publicly aspire, this letter and any ensuing correspondence will be published on the internet.

Thank you for your email.
To confirm, you have been advised on several occasions, (via email from Lucy Barry) of the Trust’s position, and you have failed to produce anything in response to show that the Trust is acting unlawfully, as you claim.
The Trust is not required to use High Court Enforcement Officers on boat removals, as it is not executing a warrant for possession. The Trust is enforcing the court ordered declaration that it has the power to remove boats from its waterways under section 8 of the British Waterways Act 1983 and section 13 of the British Waterways Act 1971.
The boat removal process that the Trust carries out is therefore lawful and legitimate. If you intend to issue legal proceedings, you are first required to set out a legal cause of action; your email below does not satisfy this requirement.

Appearances are sometimes deceptive, however, . . his reply is simply a bit of re-cycled tripe from long ago from one of the Trust's most practised and accomplished liars, Solicitor-Advocate Lucy Barry, mis-leader of the Courts and serial abuser of the Law as Parliament drafted it.

Does Tony actually believe he is doing something by voicing his opinion on a backwater forum while nursing the vain conciet that this will somehow provoke action from CRT, or is he still sufficiently in touch with reality to know that he's just kicking a can down a very lonely road?
