While nicks judgmental assumptions might be entertaining, does anybody have more details of this case? There does seem to be a distinct lack of detail. He could have been renting the boat. People rent out land dwellings for some reason so I imagine the same may happen with boats ?

I think you might be missing the point some posters are trying to make. There were things that could have been done before the S8, and yes this does need to include the 'cheap housing on the canal' but that is a very problematic issue to resolve and making people homeless will never solve it. You don’t know what was or was not done prior to the S8. Some people won’t be helped. So what is the solution in your opinion? If you don’t have a solution to offer, you are just gassing off. My solution is vote Labour! Judgemental and idiotic as it might seem to you. PS that vote will be a first for me......

It's not impossible ! I never really looked at it like that but it is possible that the top management is populated by people that don't give a shit due to their brains but I think it's more likely to be a "relentless pursuit of financial wealth" thing which is not necessarily related to autism. There is no financial gain for individuals at crt when displaying this behaviour. They don't get bonuses for this shit. This is quite simply some people's mindset, mean, vindictive, vicious, nasty and arrogant . No it is about retaining some degree of control over the canals and avoiding them degenerating into slum ghettos. Which is their job, as backed by statute.

Something which is invariably overlooked in circumstances such as this, is that whether C&RT's Section 8 powers are exercised pursuant to, or absent, a Court Order [in the form of an Injunction and Declaration] , they in truth have no authority to evict anyone from the boat they either own or are living on. The powers conferred under S.8 of the 1983 BW Act are limited to only the removal from C&RT's waterways of the offending vessel, although C&RT, as did BWB before them, unilaterally, unlawfully, and invariably extend and expand those powers to suit themselves. It's high time they were effectively challenged when next attempting to apply this procedure. In your opinion. An opinion which doesn’t seem to be shared by the courts. And guess whose opinion matters? Wrong again ! I am in fact paraphrasing HHJ Halbert, who made this point when handing down judgment in BW/C&RT -v- Geoff Mayers.

It's not even as if a BSS is particularly expensive, or required every year or anything.

It really does not come into it discussing his financial situation or wrongdoings. The facts are this, it's 2018, people are homeless, this 67 year old was brutally thrown onto the towpath, with only what he could grab on the way out. This was carried out by people advertising themselves as a charitable organisation. It's not remotely acceptable, and is disgusting.

I see where you are coming from but the simple fact is that boats have to have a BSS examination every four years. If there is some genuine reason why this has not taken place then it would be far easier to empathise but virtually no information has been provided by the GoFundMe appeal starter about the reasons behind the S8.

The Trust have many options they could have used. They chose instead to punish. A 67 year old pensioner, that's the biggest issue here. It's fuckin disgraceful and sick.

Yes, I agree it is very sad but surely CRT didn't pop round the day after the BSS expired and seized the boat? I mean, I don't know because virtually no background information has been provided, but surely they would have followed their standard procedure of increasingly strident communications reminding the gentleman of his obligations?

Your gonna say it was your son? I don't know because I haven't seen the thread you are talking about. I haven't posted on CWDF for some two years though. My son's user name there is FirstRateFirstMate. Perhaps you could point me in the direction of this thread?
