Just seen this, a 78 year old male pensioner has been charged with murder a burglar who attacked him while in the process of robbing him. Very sad for the burglar and his family but if he had not chosen to break in all would have been well The old gadger should be applauded for taking out a useless bit of garbage and certainly should not be held accountable Phil

I just put up a link a few minutes before you I agree wholeheartedly but the fact the rozzers have announced a "suspicion of murder" (which requires planning?) As opposed to manslaughter makes me think there must be a story here. Having said that looking up the Tony Martin case he did get done for murder initially. I can't understand that at all. Someone gets in your house (or boat etc) with bad intentions surely you have a right to sort them out ? Maybe its best to keep some sort acid in a spray bottle and some big cable ties.

Not completely accurate- he has been arrested on suspicion of murder but he has not (as yet anyway) been charged with any offence.

I'm going to wait and read all the facts on the front page of tomorrow's Sun before making judgement thanks. 👍

It's pretty normal for them to try for more serious charges first.

Its a bit of an awkward thing because I personally believe you should have the right to hang anyone who invades your dwelling like that but on the other hand it would open up the option of inviting someone round then hanging them and claiming they broke in. All a bit complicated. I suppose it depends on the weapon used to do the killing as well. Tony Martin made two errors. Firstly he didn't kill them both and secondly he had a 5 shot slide action shotgun without the correct license.

Two facts are he is more than twenty years senior to our own Mr Stabby and also has a higher 'Confirmed Kills' score... He's one tough old cookie!! Just what sort of 'Stabbing' does Stabby partake? 😉

The gentleman in question has done exactly what I would have done in the circumstances. Since it can never be possible to make an accurate decision as to an intruder's intentions in a split second, it is reasonable to assume that they will use lethal force if given the opportunity, and it is therefore entirely acceptable to deprive them of that opportunity by any means. If this means killing them then that is entirely reasonable and proportionate in my opinion. Nobody forced these burglars' arms up behind their backs and made them break into another person's home in the night.

I was wondering if he had stabbed the intruder with the screwdriver which the intruder had apparently been carrying maybe it would have been more of a self defense thing.
Or did he have a "that's not a knife - that's a knife" crocodile Dundee Bowie knife in the kitchen .

I also think that if anyone invades your home it should be your right to kill them. However, if it was thus, every logically minded burglar would go armed with a machine pistol.

Burglars would go armed but more serious would be the situation where someone opens the door to a known associate, friend or whatever then kills them and damages the door to look like they broke in. Its a "free kill" situation. I suppose it would usually be possible to link the people if they knew each other but not always. Maybe there should be a referendum about it.
