Ive been moored in Nottingham over the weekend and noticed the peculiar situation of castle marina charging boats to moor on the towpath outside of the marina. Talking to local boaters its something thats been happening for a while. My question is have bw/cart got the right to give a private company permission to do this. its abit worrying as there arent that many visitor moorings in notts anyway and the word on the towpath is that they are going to extend the length of towpath that they let the marina charge for. if this was rolled out nationally the decrease in available visitor moorings would be astronomical.

The same happens at Limehouse marina. The walkway leading to the Thames lock was 14 day until a few years ago but now the marina (bwml) operate it and enforce a free 24h per 7 days(£25.50 daily mooring fee after 24h). And they have a planning application to put in finger pontoons on the same bit which was previously a BW 14D towpath mooring and do paid short stay rag and stick type moorings. Gradual privatisation. I think its highly probable this will happen in a lot more places. It seems pretty much inevitable. The length of canal around the outside of Braunston marina would seem an ideal example. 24h stop then ££. (Edit to add: I don't think the bit outside Braunston marina actually is chargeable currently but I could see it going that way along with other hotspots) Nigel will probably be able to advise on the legal niceties

Same in Huddersfield, the last stretch leading to Aspley basin, 24hrs free then pay.

Moor there without paying, what can they do? Generally we would be talking about torpedoes, limpet mines and possible use of SSMs for dealing with non compliant boaters. If these all fail then the last resort is the Prop Clamp. I can assure you you do not want that. It breaks your engine mounts and bends the prop shaft when you put the engine in gear Better just move or pay up

You don't even get 24h on the ones in Nottingham, you just can't use them without paying. As for using them without paying they are full of long term moorers so effectively an extension of the marina. I'd say it's about 25-33% of the useable visitor moorings in Nottingham have been given over to them.

Same in Huddersfield, the last stretch leading to Aspley basin, 24hrs free then pay. Huddersfield/Aspley Marina - it's the bank where the red-blue boat is parked on the left in the background. It was 48 hours, I'm sure, when we were there in July 2015.

Here's another view of that towpath bank beside Huddersfield/Aspley Marina which apparently 'belongs' to the marina. If you overstay they told us they'd charge us £10/per day. Just drop an anchor and park up mid-channel!

Is the marina a bwml operation ? It's definately not a bwml operation it's owned by these people www.castlemarinas.co.uk/about-us quite a big company by the looks of it 5 inland waterway marinas and 2 costal. A prospective buyer of bwml I would have thought, especially if they can charge for the towpath outside of them all as well.

It’s not that uncommon on the system further south, that BW/CRT have sold /rented out a stretch of towpath to a for-profit commercial enterprise. Nigel and Tony will tell you that it has no basis in law but since it has been normal practice, and afaik unchallenged for a very long time, I think it would be an uphill struggle to change it.

There is a £5 charge for mooring on the River Severn at Worcester, payable to the local council via the car park pay and display machine, although curiously this charge does not apply to green boats with a yellow coachline.
