Either way, it might be a fruitful line of enquiry for Plod to have a chat with the poster on CWDF who first brought the allegation to light, to see if there is any further light they can shed on the case? Then he should be talking to them, not bragging/claiming that he has some sort of 'inside track' on the theft on an internet forum. If I've read it correctly, that person possibly does not consider what has happened to be a theft?

The only legitimate reason I can think of for this boat to have been taken due to legal proceedings would be as a result of some sort of repossession due to a default on payments on a loan secured on the boat. If that was the case there is a proper legal process to follow to be able to do that. You can't just rock up and take the boat. I'm sure that if payments have been defaulted on (and I'm not saying they have been) then there is no legal process to follow, it would seem to me to be similar to an HP company snatching back a car purchased on credit? Either way, the person who made that suggestion certainly does have some knowledge of the circumstances, rather than it being pure speculation. Now that you say it my current boat Joyce previously Orca was subject to a snatch back with over a years payments not made the boat was hiding in a river close to Ripon when BW found it the owner realising the game was up stripped the boat and ran Roy Scott Larch had the boat collected from BW and refitted, it then went to New and Used boat company at Mercia to be sold. So who knows it could be something similar? but then would the owners make a fuss about it? who knows and they have a crime number as well

Martin did you say the pontoons are fob operated. If so where did the man get keys and a fob from.i am guessing you can only get the fobs from the marina office or is it only gate access that's electronic

Of course not. But hire purchase on a boat that cost that much - I doubt it very much. Do you know what the maximum limit is for an HP loan and how much the boat cost (and how much cash deposit was used if any)? I don't. It's all speculation Martin, but there is no need to ridicule others for alternative speculation to your own (which you seem to be doing over there). There was mention of the boat costing £80K - I don't believe you can get HP for that amount or anything close to it nor do I believe anybody offers HP on boats any way. But even if they were it means they would have had to pay a substantial amount as deposit which in turn diminishes the HP companies' ability to just 'snatch it back'. This in turn means the only type of loan you can get secured on a boat is a marine mortgage which further in turn means it can't just be 'snatched back'. I am calling their speculation silly because I believe they are utterly silly simply because they are not thinking through about what they are posting. Unless they can substantiate what they are saying they risk legal action themselves for potentially sullying the name of the owners and the Marina. For one thing it wouldn't be the builder re-posessing the boat it would be marine mortgage company in that situation. If they have evidence that the owners are wasting police time by claiming the boat has been stolen when in fact it hasn't they should be talking to the police, not posting random allegations on the internet behind an anonymous Internet ID.

Then as I have said (twice now) they should be discussing it with the Police as he or she is basically accusing the owners and the marina of wasting police time, which is quite a serious allegation. Until they confirm they have done this it's noting more than time wasting mischief making and something that could land them in hot water too.

Yes in theory you need a fob but as I said in the thread on CWDF you can 'tailgate' behind a car too.

The police wouldn't be remotely interested in such an event unless there was some other requirement for them to be involved such as some sort of disorder or assault as a result of the re-possession. Unless there is it is purely a civil matter. They would also take a very dim view of wasting their time in such a manner and likely would follow through a prosecution for doing it.

I should add for clarity of course that if indeed the boat has been taken as a result of some dispute between two parties then unless the 'aggrieved' party has the legal right to take that boat then in the eyes of the law it has been stolen, is reportable as such and should be treated as such.
Its still theft and the owners are entitled to have their property returned and the thief prosecuted.

I would still look in stenson yard Stenson marina is about a half hours walk up the towpath from Mercia so it wouldn't be hard to do, if it hasn't been done already.

It certainly seems strange that nobody has spotted it, which leads one to believe that it has been carefully hidden away rather than being cruised on.

One curious thing is that Google matches the mobile number given out, to someones public address book with a different name (but similar) to the owners. As an aside, it's made me wonder how many of our mobile numbers have been made public by accident.

Yes possible certainly, that did cross my mind too. But they don't live on the boat as I read it anyway so they should be aware of any correspondence leading up to that point.

He must be running out fuel by now.i email all the yards selling fuel within an 100 mile radius of mercia to ask them to look out for it.i really think it's way out the area people are searching.you can get a long way in a few weeks.Sometimes the best way to hide summet is with others looking the same.If you want to hide a tree you would put it in a forest
