Had Mazeriak only just stopped, I think Wagstaff may have had a reasonable chance of acquittal on the grounds that a stationary vehicle with lights extinguished parked in lane 1 was something which a reasonable person could not foresee. Not sure whether I remember correctly but I can't remember reading that the minibus had turned it's lights off. Which would block the lorries lights then. Question would be how long was the mini bus stationery? He may get off yet.

I suppose the bottom line is that the hours all three of these drivers were working isn't called "the graveyard shift" for nothing. The whole incident is the tragic result of three diurnal creatures being forced into nocturnal activities. The FedEx driver will be hanged for having been on his mobile phone but I've read numerous comments from night drivers on TruckNet that this is what you have to do in a desperate attempt to stay awake.
When I started driving and occasionally drove home from gigs in the early hours there were virtually no other vehicles on the road. From what I understand it's now virtually as busy on the roads at night as it is during the day.

In my mind, there was only 1 moving vehicle This driver is wholly responsible for the deaths. The other charges should be dealt with in accordance to the law.

From what I understand it's now virtually as busy on the roads at night as it is during the day. In 2005 when I took the Witch for the first time to have a quick trip round England, I said we'd nip up to the Lake District through the night, with our arrival at Stansted being around 10pm, as the roads are empty or much quieter. I was surprised to see a stream nose-to-tail lorries all the way up the M6. It's still a clever way of crossing the country, at night. But you must keep your eyes open for badgers!

I have probably changed my mind 20 times.
I am currently of an opinion that the following drivers actions may not of been danerous. Using a mobile phone is only due care and attention.
Did his driving fall far below that of a carefully and competent driver or was it just below that of a blah blah blah.
If as suggested he hit an unlit vehicle on a live motorway lane. Then I would at the moment say it does not fall far below.
Just because deaths are involved is not a reason to up a charge to dangerous.
I am going to say it but the dead minibus driver should shoulder some blame. He also stoped in a live lane. Which as we don't know the circumstances can not hold that against him however, if he turned his lights off and did not put any hazard lights on. That would be a factor in the cause of the collision.

It's station Ary for something standing still, Mr bfg, and station Ery for all that shit you find in offices. The way I was taught this at school was that stationery is sold by a stationer, just as grocery is sold by a grocer.

This bellend at 06.00 this morning is travelling along a 'not suitable for HGVs' country road shortcut from M6 j27 to local market gardeners town this morning and going over a 7T bridge here.... You can see where the bridge has been constantly battered by truck trailers...they don't even repair it now just leave bollards round it!!🙄🙄 Wonder where he's from??
